  • Use of Disclosure of Protected Health Information (PHI) – MOM will use or access only the PHI necessary to provide the services we are contracted, and only to the extent we are permitted or required by law. In the event PHI must be disclosed to any subcontractors or agents, MOM will ensure they have implemented the appropriate safeguards and obtain an agreement ensuring they agree to abide by the same restrictions and conditions that apply to us.

  • Safeguards – We use appropriate safeguards to prevent the use or disclosure of (e)PHI other than as provided for in the business associate (BA) agreement, as well as administrative, physical, and technical safeguards that protect the confidentiality, integrity, and availability of (e)PHI that we create, receive, maintain, or transmit on behalf of a covered entity.

  • Breach notification – In the event of a possible PHI breach, we will notify you in a timely manner, and where possible provide a list of compromised patients. We will investigate the breach and mitigate to the extent practicable any harmful impact of this breach.

  • Access and amendment to PHI – We will honor your requests to abide when individuals exercise their rights of access, amendment, and accounting in accordance with HIPAA regulation. Upon request, we will make our internal practices, books, and records relating to the use and disclosure of PHI received from or created or received by us on behalf of you available to the U.S. Department of Health and Human Services for the purpose of determining compliance with the terms of the BA Agreement and appropriate HIPAA regulations.
